TEXT ORDER: The Court is in receipt of respondents' answer to the Petition. (ECF No. 4.) I find that the recent decision in Bethancourt- Soto v. Soto, et al., No. 25-cv-16200, __ F. Supp. 3d __, 2025 WL 2976572 (D.N.J. Oct. 22, 2025) applies as petitioner was apprehended inside the United States after residing here for an extended period. Therefore, I find that petitioner should be detained under 8 U.S.C. § 1226, which requires an opportunity to seek bond. It is ORDERED that the immigration court shall provide petitioner with a bond hearing no later than 5:00p.m. on January 13, 2026. Respondents shall file a letter on the docket indicating the date and time of the bond hearing by 12:00 p.m. on January 9, 2026. Within 3 days of that bond hearing, respondents shall file a written notice of the outcome of the hearing. So Ordered by Judge Edward S. Kiel on 1/7/2026. (gn) (Entered: 01/08/2026)

TEXT ORDER: This Court is in receipt of petitioner's letter alleging that he did not receive due process during his bond hearing. (ECF No. 7). This Court lacks jurisdiction to review any discretionary determinations underlying the immigration judge's bond decision, but it can review whether the bond hearing was fundamentally unfair. Ghanem v. Warden Essex Cnty. Corr. Facility, No. 21-1908, 2022 WL 574624, at *2 (3d Cir. Feb. 25, 2022). Petitioner is ORDERED to provide a copy of the hearing transcript and a brief memorandum addressing how the hearing was unfair by January 22, 2026.
