ORDER: Before the Court is an Emergency Motion to Enforce Judgment filed on March 10, 2026, by one of the Petitioners, Ibrahim Mohammed. (Doc. 31). According to the Motion, around 10:40 p.m. on Monday, March 9, 2026, Mr. Mohammed's counsel learned that ICE has re-detained Mr. Mohammed "again, in apparent violation of this Court's February 6, 2026 Order." (Doc. 31-1 at 1) (alleging re-detention with 'no due process and no indication of changed circumstances'). Counsel has also filed a Motion to Supplement (Doc. 32) the Emergency Motion with two Exhibits (Exhibit A (Doc. 32-1) and Exhibit B (Doc. 32-2)) indicating that while Mr. Mohammed is in ICE custody, his exact location is unknown. Given these representations and filings, IT IS ORDERED that the government has until 8:00 a.m. on Tuesday, March 11, 2026, to file its response to the Emergency Motion to Enforce Judgment (Doc. 31). RULING AND ORDER: IT IS ORDERED that the Emergency Motion for a Temporary Restraining Order (Doc. 34) is GRANTED. The government shall not remove Mr. Mohammed from the United States for a period for five (5) days. IT IS FURTHER ORDERED that, by Marc h 12, 2026, the parties shall enter simultaneous briefs addressing the due process afforded Mr. Mohammed on his re-detention. Briefs shall address the process due at revocation of his order of supervised release, including whether an informal intervi ew took place, where, when, with whom, and whether Mr. Mohammed was allowed access to his counsel. Briefs shall also address the process due to a noncitizen prior to removal to a third country, and if and how that standard is different for a noncitiz en with CAT protection. Finally, briefs should address the current status and whereabouts of Mr. Mohammed. IT IS FURTHER ORDERED that the government shall arrange for Mr. Mohammed to be able to contact his counsel for a legal call, and to be given th e time and privacy to do so meaningfully. Minute Entry for proceedings held before Judge John W. deGravelles: Status Conference by zoom held on 3/19/2026. The Court held this status conference in response to Petitioner's [44] Notice of Request for Emergency Status Conference, in which Petitioner's counsel detail their attempt to meet with Petitioner in person at the River Correctional facility for a scheduled legal meeting. Considering these representations, no further action was taken, but the Court expressed its concern over this near-transfer and the effect on Petitioner's access to his counsel and impressed upon the parties that further instances of such tactics may be met with a contempt hearing. Finally, considering the foregoing, Petitioner's [44] Notice of Request for Emergency Status Conference is GRANTED. (EDC)
