EMERGENCY ORDER CONCERNING STAY OF TRANSFER OR REMOVAL: The Clerk of this Court shall serve a copy of the petition and this Order (by email) on the civil duty attorney for the United States Attorney's Office and the United States Attorney for the Northern District of Illinois. Pursuant to the Court's authority to order Respondents to preserve the status quo to ensure fair and orderly consideration of this matter, and to rule on any contested issues concerning jurisdiction, it is hereby ORDERED that, unless otherwise directed by this Court, Respondents shall not remove Petitioner from the jurisdiction of the United States, nor shall they transfer Petitioner to any judicial district outside the State of Illinois, prior to 5:00 PM Central Standard Time on June 13, 2025. See United States v. United Mine Workers of Am., 330 U.S. 258, 293 (1947) ("[T]he District Court had the power to preserve existing conditions while it was determining its own authority to grant injunctive relief."). If Petitioner has already been removed or transferred outside the jurisdiction of this Court or the State of Illinois, Respondents are ORDERED to immediately notify the Court in writing of the Petitioner's current locations, including the specific judicial district and facility where Petitioner is held. Such notice shall be filed in writing on the docket no later than 12 hours from the time this Order is docketed. The Court sets this matter for an in-person status hearing on Friday, June 13, 2025 at 2:00 PM CST in Courtroom 1941. MODIFIED EMERGENCY ORDER CONCERNING STAY OF TRANSFER OR REMOVAL: In-person hearing held on Petitioner's emergency petition for writ of habeas corpus 1 held on 6/13/2025. The Court grants Attorney William Mclean's motion for leave to appear as Co-Counsel 5 . Petitioner's memorandum in support of preliminary injunction (or equivalent relief) is to be filed on or before 6/16/2025. Respondents' response is to be filed on or before 6/19/2025 (understanding that is a federal holiday). The case is set for an in-person hearing on 6/25/2025 at 1:30 PM. The hearing will be held in Courtroom 1941. As the Court informed the parties during the hearing, this Court handled the emergency petition and set this hearing as the emergency judge, so future proceedings will be handled by the assigned judge. The Emergency Order Concerning Stay of Transfer or Removal entered on 6/12/2025 2 is extended through 5:00 PM Central Daylight Time on 6/25/2025, and is modified to allow Petitioner to be housed not only in the State of Illinois, but also the States of Indiana and Wisconsin before 6/25/2025 at 5:00 PM Central Standard Time, based on Respondents' counsel's representation that Petitioner cannot legally be housed overnight in the State of Illinois. Counsel for Respondents represented on the record that, if Petitioner is transferred to the States of Indiana or Wisconsin, they: (1) waive any arguments related to improper venue, and (2) will not contest personal jurisdiction, so long as service of the habeas petition is effectuated on Respondents by Petitioner's counsel. In addition, Respondents are hereby ordered to enable and facilitate an in-person meeting between Petitioner and his attorney(s) by no later than 6/18/2025. Signed by the Honorable Franklin U.
