ENDORSED ORDER: According to the status reports filed by the petitioner, the Immigration Court held a bond hearing on January 20, 2026 and found that the petitioner was subject to mandatory detention and consequently refused to conduct a hearing on whether the petitioner constituted a flight risk or a danger to the community. See Status Report, doc. no. 12 at 2-3. The petitioner avers that the government argued to the Immigration Court, but not to this court, that the petitioner should be detained under 8 U.S.C. § 1226(c)(1)(E). Id. The petitioner requests an opportunity to present argument to the court on "the issue of whether he is, in fact, subject to mandatory detention" under this statute. See Status Report, doc. no. 10 at 2. Accordingly, on or before February 13, 2026 the petitioner shall provide the court with supplemental briefing of no more than 7 pages (excluding exhibits) on the issue of his detention under 8 U.S.C. § 1226(c)(1)(E). The government shall have 7 days from the date of the petitioner's filing to respond. The parties are also directed to provide the court, by February 6, 2026, a copy of the Immigration Court's decision from the January 20 hearing. So Ordered by Judge Joseph N. Laplante.
