ORDER TO SHOW CAUSE: The Court received the Petition at approximately 8:40 p.m. after it had been purportedly filed. It is hereby ORDERED that: To preserve the Court's jurisdiction pending a ruling on the petition, Petitioner shall not be removed from the United States unless and until the Court orders otherwise. Petitioner shall not be transferred except to a facility within this District, the Eastern District of New York, or the District of New Jersey absent further order of this court light of Petitioner's interests in participating in further proceedings before this Court and maintaining adequate access to legal counsel through these proceedings. The parties shall attend an initial telephonic case conference on Monday, December 29, 2025 at 10:00 a.m. ET. The dial-in number is 1-855-244-8681 and the access code is 2309 3085 835. There is no attendee ID. The parties should be prepared to address venue, under what statutory provision petitioner is being detained under, and provide additional details about Petitioner's detention, such as Petitioner's A-number and any other accompanying documents. ORDER: Evelyn Maria Tesen Salas ("Petitioner") has, through next friend Margaret Young, filed a Petition for the writ of habeas corpus pursuant to 28 U.S.C. § 2241 on December 24, 2025. Doc. 1. Petitioner, through pro bono counsel, informed the Court on December 29, 2025 that the parties met and conferred to discuss whether venue is proper in this district and address other issues discussed in the initial conference. Doc. 8 at 1. In the letter, the parties informed the Court that the Government does not challenge venue in this case and that Petitioner's counsel intends to file an Amended Petition. The Court, having examined the original Petition, and the parties' joint letter dated December 29, 2025, hereby ORDERS that: (1) Petitioner shall file the Amended Petition by January 9, 2026; (2) Respondents shall file an answer to the Amended Petition by January 20, 2026; and (3) Petitioner shall file any reply by January 26, 2026. To preserve the Court's jurisdiction pending a ruling on the Petition, Petitioner shall not be removed from the United States absent further order of this Court. (And as further set forth herein.)
