PAPERLESS ORDER Denying 3 Petitioner's Emergency Motion for Temporary Restraining Order and Preliminary Injunction. "At minimum" [ECF 3 at page 13], the petitioner seeks injunctive relief, so she must show that she is (1) likely to succeed on the merits and (2) likely to suffer irreparable harm otherwise, where (3) the balance of equities favor an injunction and (4) injunctive relief is in the public interest. See Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7, 20 (2008). However, success is unlikely, where the Court "lack[s] jurisdiction to enjoin the respondents from transferring [her] to another facility." Flores-Reyes v. Assistant Field Off. Dir., 26-cv-20226, 2026 WL 406708, at *4 (S.D. Fla. Feb. 13, 2026). Specifically, under 8 U.S.C. § 12529(a)(2)(B)3 and 8 U.S.C. § 1231(g)(1), the Court may not "enjoin the government from transferring immigration detainees to other districts, as those decisions fall within the discretion of the Attorney General." Accordingly, the Court must deny the Motion. Signed by District Judge Jeffrey T. Kuntz (JTK) (Entered: 10/31/2026)
