MINUTE ORDER: Respondents' 7 Motion for Extension of Time to Respond to Order to Show Cause (ECF No. 4) is GRANTED in part and DENIED in part.As Respondents acknowledge, the Court's 4 Order required that Respondents shall respond to the 1 Petition and show cause why the Petition shall not be granted within seven days of service. See [Doc. 7 at 1]. Respondents were served on January 7, 2026. [Id.]; see [Doc. 5]. Accordingly, Respondents' response was due January 14, 2026, not January 15, 2026 as Respondents contend.Because the deadline for timely filing a motion for extension of time had already expired before Respondents filed their 7 Motion, the proper standard to determine whether an extension is justified is excusable neglect rather than good cause. Fed. R. Civ. P. 6(b)(1)(B); see also Weil v. Carecore Nat., LLC, No. 10-cv-00799-CMA-CBS, 2011 WL 1938196, at *2 (D. Colo. May 19, 2011). Press of business generally does not constitute good cause or excusable neglect. Further, Respondents concede that they knew, as of January 13, 2026, that Petitioner opposed any extension of time for Respondents to file their response. See [Doc. 7 at paragraph 9].Respondents may have until January 16, 2026 to respond to the 1 Petition and show cause why the Petition shall not be granted. By Judge Nina Y. Wang on 1/15/2026.
