MINUTES (In Chambers) Order REQUIRING Response to Petitioner's Ex Parte Application for Temporary Restraining Order [Dkt. 2] by Judge Kenly Kiya Kato. The Court is in receipt of Petitioner's Ex Parte Application ("Application") for Temporary Restraining Order ("TRO"). Upon review of the Application and Petitioner's Petition for Writ of Habeas Corpus ("Petition"), the Court finds Petitioner is a member of the Bond Eligible Class certified in Maldonado Bautista v. Santacruz, No. EDCV 25-01873-SSS-BFMx (C.D. Cal.) As such, Petitioner is entitled to a bond hearing consistent with the Court's final judgment in Bautista. Despite this, Petitioner remains detained and has been denied access to a bond hearing. Therefore, IT IS HEREBY ORDERED that Respondents shall submit a Response by October 29, 2026, at 5:00 PM, addressing whether Respondents object to Petitioners membership in the Bond Eligible Class. If membership in the Bond Eligible Class is not contested, the Court will issue a subsequent order granting relief to Petitioner consistent with the Courts orders in Bautista. Additionally, pursuant to General Order 26-05, see Dkt. 4, and to preserve the Courts jurisdiction pending a ruling in this matter, IT IS ORDERED that Petitioner shall not be removed from the Central District of California pending resolution of this litigation. (SEE DOCUMENT FOR FURTHER INFORMATION). (aco) (Entered: 10/28/2026)
