Respondents filed their response to petitioner Dagmar Jesus Diaz-Gonzalez's habeas petition and motion for a temporary restraining order (TRO) four days late, and hours before Diaz-Gonzalez's deadline to file a reply. See 19 (order setting briefing schedule); 21 (late response). Diaz-Gonzalez moves to strike the late response or, at the very least, extend his deadline to reply. The court will hear argument on the motion to strike at the TRO hearing on Tuesday, February 17, 2025. In the meantime, Diaz-Gonzalez's deadline to file a reply in support of the TRO motion is EXTENDED to noon on February 17, 2025. The court finds that the reply will aid the court's preparation for the TRO hearing in the event that the motion to strike is denied. MINUTE ORDER IN CHAMBERS of the Honorable Judge Jennifer A. Dorsey on 2/22/2026 directing supplemental briefing regarding motion for TRO 17 .In a supplemental filing on 2/20/26, petitioner Dagmar Diaz-Gonzalez withdrew his request for emergency intervention related to his medical care and accommodations. 32 The court orders NSDC and Diaz-Gonzalez to file a status report in 30 days detailing his continued medical treatment during his detention. Within 14 days, NSDC must disclose to Diaz-Gonzalez's counsel any treatment plans or related documents it has in its possession related to his care. Also on 2/20/26, the respondent provided new (and different) information regarding third-country removal, and in petitioner's supplemental filing, he provides legal argument on that point. 32 He maintains that relief in the form of a TRO is warranted to prevent his removal to a third country. IT IS ORDERED that respondents must file a supplemental brief responding to that argument in ECF No. 32 by Thursday, February 26, 2026.
