MINUTE ORDER (Text Only Entry) The Court has reviewed the Petition filed under 28 U.S.C. § 2241 (Doc. 2) and the related request for emergency injunctive relief (Doc. 4). Petitioner asserts he is being subjected to unlawful detention. The facts presented indicate that he was provided a substantive bond hearing after which the IJ granted release on a bond. The government filed a notice of intent to appeal to the BIA, triggering the automatic stay. (Doc. 4 at 9) He asserts that this Court should order his immediate release despite the stated intention by the government to appeal. The authority cited for this proposition does not seem to apply due to the factual differences. Even still, the Court finds that Petitioner raises a serious question as to the process he is due. Thus, pursuant to 28 U.S.C. § 2243, Respondents are ordered to show cause in writing no later than January 15, 2026 why the Court should not grant Petitioner's motion for a temporary restraining order. Any response SHALL provide the Court with copies of referenced/relevant portions of Petitioner's A-File and other supporting documents. Petitioner may file a reply no later than January 20, 2026. The Court further directs the parties to indicate on or before their respective filing deadlines (1) whether they are requesting a hearing; and (2) whether they agree to convert the request for a TRO into a preliminary injunction without further briefing. Depending on the content of the filings, the Court may set a hearing or may rule on the papers.No later than January 7, 2026, to the extent this has not yet occurred, Petitioner SHALL give notice of this action to the U.S. Attorney's Office for this district signed by District Judge Jennifer L. ORDER GRANTING 4 Request for Preliminary Injunction and REFERRING the Matter to the Assigned Magistrate Judge, signed by District Judge Jennifer L. Thurston on January 29, 2026. Petitioner's Motion for Temporary Restraining Order (Doc. 4) is converted into a Preliminary Injunction and is GRANTED. Petitioner SHALL post a $5,000 bond according to the requirements of the U.S. Immigration Court as ordered by the Immigration Judge on December 23, 2025. Within three Court days, Respondents SHALL make arrangements to accept Petitioner's bond payment, provide Petitioner with instructions on how to make payment, and notify Petitioner when the portal is ready for payment. Upon payment, Respondent s are ORDERED to immediately release the Petitioner under his former conditions of release. Respondents are ENJOINED and RESTRAINED from re-detaining Petitioner under 8 U.S.C. § 1225(b)(2) unless upon a change of circumstan ces. If Respondents seek to re-detain the Petitioner, Respondents SHALL provide no less than a seven-days' advance notice and SHALL hold a pre-deprivation bond hearing before a neutral decisionmaker, where the government bears the burden of demonstrating by clear and convincing evidence that Petitioner is a flight risk or danger to the community such that his physical custody is justified. The matter is REFERRED to the assigned magistrate judge for consideration of the merits of the petition. The Court sets the following briefing schedule, which may be modified by the assigned magistrate judge as necessary: a.) To the extent Respondents wish to file a brief responsive to the merits of the petition, they SHALL do so within 21 days. Should they choose not to do so, they SHALL file a notice indicating they wish to stand on their current filings. b.) Petitioner may file a traverse to any addition brief Petitioners file within 14 days thereafter. If Respondents do not file an additional brief, the matter will stand submitted upon filing of Respondents' notice, unless the magistrate judge chooses to hold a hearing. (Deputy Clerk OFR)
