ORDER TO SHOW CAUSE: Respondents are directed to show cause by 10/16/2026 why petitioner's 2 habeas petition should not be granted, and to respond to petitioner's 3 motion for a temporary restraining order. In their response to this order, respondents should state the location at which petitioner is currently detained; the location at which petitioner was detained when her petition was filed, and when petitioner's counsel was informed of petitioner's location; and the status of petitioner's immigration proceedings. Respondents should also explain the statutory authority for petitioner's detention and whether the petition is controlled by the Second Circuit's opinion in Barbosa da Cunha v. Freden, 175 F.4th 61 (2d Cir. 2026). Alternatively, if respondents concede that Barbosa da Cunha controls, they may waive the right to a response and consent to petitioner's release without prejudice to their rights on appeal. If the respondents file a response, the petitioner may file a reply by 10/23/2026.The Clerk of Court is respectfully directed to email a copy of this order, the 2 petition, and the 3 motion to the Chief of the Civil Division of the U.S. Attorney's Office for the Eastern District of New York, by the end of day today. Ordered by Judge Rachel P. Kovner on 10/9/2026. (AFK)

ORDER: The Court is in receipt of the government's 7 response, in which the government represents that petitioner was in New Jersey when her habeas petition was filed; that petitioner had been in New Jersey for over 12 hours at that time; and that petitioner had placed calls from New Jersey before her petition was filed. In general, a district court has habeas jurisdiction only if petitioner was in its district "[a]t the time the petition was filed." Ozturk v. Hyde, 136 F.4th 382, 391 (2d Cir. 2025). Given that petitioner's 3 emergency motion requested, in the alternative, that the Court transfer her habeas petition to the court with jurisdiction over it, petitioner is directed to confirm by 10/23/2026 whether she consents to this case being transferred to the District of New Jersey. Petitioner may do so in a reply in support of her petition, also due by 10/23/2026, or in a separate filing. Ordered by Judge Rachel P. Kovner on 10/20/2026. (AFK)

ORDER TRANSFERRING CASE: Petitioner filed a 1 petition for a writ of habeas corpus on 10/7/2026, and a 3 motion for a temporary restraining order on 10/8/2026. Petitioner's 3 motion stated that on 10/7/2026, "almost contemporaneously" with the filing of the petition, Petitioner's counsel "learned...that [p]etitioner had been transferred" from the Eastern District of New York "to a detention facility in Elizabeth, New Jersey." Mot. for Temp. Restraining Order 6 (Dkt. #3). It thus requested that the Court "either find that it has jurisdiction based on the circumstances at the time counsel first attempted to file the [p]etition or, alternatively, transfer the petition to the Court having jurisdiction." Id. 7. Responding to the petition, the government stated that petitioner was in New Jersey when her habeas petition was filed; that petitioner had been in New Jersey for over 12 hours at that time; and that petitioner had placed calls from New Jersey before her petition was filed. Response 1-2 (Dkt. #7); Sweeney Decl. 5-9 (Dkt. #7-1). The government also represented that petitioner had since been transferred to Louisiana, where she remained as of the government's writing. Sweeney Decl. 10-11. The Court then ordered petitioner to confirm by 10/23/2026--the date the reply in support of her petition was due--whether she consented to her case being transferred to the District of New Jersey. Petitioner did not consent to or contest a transfer by 10/23/2026."The Supreme Court has made clear 'the general rule that for core habeas petitions challenging present physical confinement, jurisdiction lies in only one district: the district of confinement.'" Ozturk v. Hyde, 136 F.4th 382, 391 (2d Cir. 2025) (quoting Rumsfeld v. Padilla, 542 U.S. 426, 443 (2004)). "The district of confinement is the district in which the petitioner is physically present at the time that a habeas petition is filed." Cepeda v. Francis, No. 25-CV-10756 (MMG), 2026 WL 63314, at *1 (S.D.N.Y. Jan. 8, 2026); see Ozturk, 136 F.4th at 391 (considering the district of confinement "[a]t the time the petition was filed"). Here, petitioner has not contested the government's representation that he was confined in the District of New Jersey when he filed his petition. The Clerk of Court is thus respectfully directed to transfer this matter to the District Court for the District of New Jersey. Consistent with petitioner's request, see Mot. for Temp. Restraining Order 7, the Clerk of Court is further respectfully directed to transfer this matter immediately, without regard for Local Civil Rule 83.1. Ordered by Judge Rachel P. Kovner on 10/26/2026. (AFK)
