ORDER. Upon careful review of the parties' submissions, it is uncontested that Petitioner Albeto Pierre ("Petitioner") was transferred to Florida after his petition was filed in this District. Thus, the Court is faced with the question whether a prisoner's post-filing transfer to another jurisdiction impacts this Court's ability to grant habeas relief. The Court of Appeals for the First Circuit ("First Circuit") has not decided this question. See, Williams v. Warden, FCI Berlin, 786 F.Supp. 3d 436, 446 (D.N.H. 2025). However, this Court recognizes that "[f]or immigration habeas petitions, 'jurisdiction lies in only one district: the district of confinement.'" Lopez-Arevelo v. Ripa, No. EP-25-CV-337-KC, 2025 WL 2691828, at *5 (W.D. Tex. Sept. 22, 2025) (citing Trump v. J.G.G., 604 U.S. 670, 672 (2025)). Therefore, the Court finds that Petitioner is properly before the Florida Middle District Court where he is currently confined. A notice to appear before an immigration judge in Broward County, Florida on January 29, 2026 has been issued. (ECF No. 20-1). Considering the above and lacking a clear directive from the First Circuit, the Court finds that the post-filing transfer out-of-district defeats jurisdiction since there is no one who would be an appropriate respondent remaining within this district. See Williams, 786 F.Supp. 3d at 446 (collecting cases); Parker v. Hazelwood, No. 17-CV-484-LM, 2019 WL 4261832, at *5 (D.N.H. Sept. 9, 2019) (explaining that, after petitioner had been transferred to another district, "[a]ny writ issued by this court would be ineffectual because [petitioner's] immediate custodian is outside the reach of this court's territorial jurisdiction."). Accordingly, in the interest of justice, this Court orders this case to the transferred to the Florida Middle District Court. This case is transferred to the Florida Middle District Court.
