ORDER - Upon review of this matter, the Respondents' Motion to Dismiss, and Case No. 2:25-cv-309 pending in the Southern District of West Virginia, the Court has determined that it is necessary for Respondents to address the merits of Petitioner's claims raised in the Petition. While the Court recognizes that Petitioner has a pending habeas matter in the Southern District of West Virginia, that Court has taken no action in that matter since July 1, 2025. Indeed, the petition has not even been served on the Respondents. Additionally, the petition in that case was filed on April 1, 2025, presumably before Petitioner was subject to a final order of removal (the EOIR indicates that the BIA dismissed his appeal on October 3, 2025). Therefore, it is likely that the claims raised in the petition pending in the Southern District of West Virginia are moot since the statutory framework governing his detention has changed since that petition was filed. Petitioner was in custody at the Moshannon Valley Processing Center when he initiated this action and therefore this Court has jurisdiction over this matter to the extent Petitioner is challenging the legality of his custody.
