TEXT ORDER: This matter comes before the Court on Petitioner Ana Alejandra Gutierrez Pedrozo's letter request for an expedited ruling on immediate release and opposition to the extension of the filing deadline (ECF No. 6). This Court previously granted Respondents' request for a one-day extension of the deadline to file an update with the Court on the outcome of Petitioner's bond hearing. (ECF No. 5.) That Order is now withdrawn following Petitioner's motion in which she informs the Court that she did not request the bond hearing to be rescheduled. (ECF No. 6.) The Court's Order at ECF No. 2 states that a petitioner detained pursuant to 8 U.S.C. § 1226(a) must be given a bond hearing within three (3) days of the entry of the Order or be released from custody. The Order was entered on October 26, 2026, and Respondents have rescheduled the bond hearing to take place on November 5, 2026, which is outside of that deadline. (ECF No. 4-2.) Accordingly, the Court WITHDRAWS its prior Order at ECF No. 5, and Respondents are ORDERED to RELEASE Petitioner within twenty-four (24) hours, or, if Petitioner has a criminal history, file evidence of that criminal history along with Petitioner's custody documents within the same twenty-four (24) hour deadline. Respondents shall file a letter updating this Court on Petitioner's release from custody within twenty-four (24) hours following her release. So Ordered by Judge Katharine S. Hayden on 11/3/26.
