Judge Richard G. Stearns: ELECTRONIC ORDER entered re 7 Response to Petition for Writ of Habeas Corpus - 2241 filed by Jeffrey Marian Grimming, Markwayne Mullin, David Wesling, Todd Blanche, and Antone Moniz. The government attaches to its Response, a copy of the Immigration Judge's (IJ) Opinion dated September 23, 2026, ordering Petitioner Mauricio Soares Ribeiro's removal to Brazil for his failure to appear at his removal hearing. The IJ notes that, at an earlier hearing, Ribeiro "admitted the factual allegations in the Notice to Appear and conceded removability." Dkt #7-1 at 1. While the court is not lacking in sympathy for the petitioner's plea for release from detention, the court has no jurisdiction to grant the relief he requests. Under section 242(g) of the Immigration and Nationality Act (INA), a District Court has no jurisdiction to hear a claim arising from the execution of a removal order. As sections 242(a)(5) and (b) (9) of the INA make clear, any such jurisdiction is vested in the Court of Appeals. The opportunity to challenge a removal order in the Immigration Court and, if applicable, in the Court of Appeals, is the due process that the Fifth Amendment guarantees to petitioner and others similarly situated.Notwithstanding, the court will provide Soares Ribeiro five days (until Wednesday, November 4, 2026) if he wishes to file a Reply to the Government's Response.
