Judge Brian E. Murphy: ELECTRONIC ORDER denying 1 the petition for writ of habeas corpus. To the extent Petitioner is alleging undue delay by the Board of Immigration Appeals ("BIA"), such a challenge must be brought via the Administrative Procedure Act, 5 U.S.C. § 706(1), and via a claim for a writ of mandamus, 28 U.S.C. § 1361, rather than via a habeas petition. To the extent that Petitioner intends this Court to review the decision of the immigration judge, notwithstanding his BIA appeal, see Miti v. Moniz, 827 F. Supp. 3d 206, 216-17 (D. Mass. 2026) (not requiring exhaustion before the BIA before challenging the sufficiency of a bond hearing before this Court), Petitioner must file a motion to enforce the Court's judgment, explaining why he believes his June 25, 2026 bond hearing was constitutionally inadequate. The petition is therefore DENIED without prejudice.(MBM) (Entered: 10/21/2026)
