TRANSFER ORDER: In his 1 First Petition for Writ of Habeas Corpus and Emergency Application for TRO and Preliminary Injunction (28 U.S.C. § 2241), Petitioner challenges his ongoing detention by U.S. Immigration and Customs Enforcement. The Original Petition was not initially on the docket due to an administrative error. To the extent that Respondent's Opposition states that Petitioner "himself acknowledges in the Petition he was detained in New Jersey at the time this Petition was filed," see Opposition to Order to Show Cause ("Opposition") at 1, Dkt. 7, the Court notes that at the time the Original Petition was filed on 10/7/2026, see Dkt. 1-6, Petitioner's counsel represented, upon information and belief, that Petitioner was still in New York. However, according to Respondents' records, Petitioner is currently detained at the Delaney Hall Detention Facility in New Jersey and has been detained in New Jersey since the time at which the Petition was filed. See Opposition, Dkt. 7. It is well settled that § 2241 requires a habeas petitioner challenging his present physical confinement to file a petition in the district of confinement. See Rumsfeld v. Padilla, 542 U.S. 426, 443 (2004); Trump v. J.G.G., 604 U.S. 670, 672 (2025) (per curiam). Based on Respondents' representation that Petitioner has been detained in New Jersey since the time at which the Petition was filed, see Opposition, Dkt. 7, venue in this District is improper. The Clerk of Court is directed to transfer this action to the U.S. District Court for the District of New Jersey and to close this matter. The Court waives compliance with Local Rule 83.1, which otherwise imposes a seven-day delay in the effectuation of the transfer. Ordered by Judge Orelia E. Merchant on 10/14/2026.
