Endorsed Order - not on motion
Oct 27, 2026
ENDORSED ORDER re: 7 Notice, 8 Emergency MOTION for Temporary Restraining Order. Text of Order: "The district court... has inherent authority to protect its proceedings, and to accord all the relief necessary to correct... particular injustices." Ozturk v. Hyde, 136 F.4th 382, 394 (2nd Cir. 2025) (quotations, brackets, and citation omitted). Petitioner has a right to counsel, and respondents' proposed transfer to an unknown detention center outside of New England following any denial of bond but before the court's resolution of this habeas petition would meaningfully interfere with that right. Lahamendu v. Bondi, No. 2:25-CV-02155-LK-SKV, 2025 WL 3066437, at *5 (W.D. Wash. Nov. 3, 2025). Though the court will retain jurisdiction over this petition notwithstanding petitioner's transfer, continued jurisdiction does not on its own guarantee the integrity of the habeas corpus proceeding. Id. There is a lack of adequate assurance in the record that petitioner would have a meaningful opportunity to confer with her counsel before such a transfer, and that counsel would be able to locate his client or adequately communicate with her after. Accordingly, respondents shall not remove or transfer the petitioner outside of the District of New Hampshire for seven (7) calendar days following any denial of bond by the Immigration Judge at the hearing currently scheduled for October 27, 2026. If petitioner is granted bond at that hearing, this order will be moot. So Ordered by Judge Landya B. McCafferty.(de)
