ORDER: Counsel for Petitioner must immediately serve the Petition upon Respondents. If not already issued, the Clerk's Office must issue any properly complete summonses. The Clerk of Court must immediately transmit by email a copy of this Order and a copy of the Petition, and Motion for Temporary Restraining Order and Preliminary Injunction to the United States Attorney for the District of Arizona, to the attention of Katherine Branch, Melissa Kroeger, and Lon Leavitt. Respondents must answer the Motion for Temporary Restraining Order and Preliminary Injunction no later than 12:00 p.m. on Friday, July 11, 2025. Petitioner may reply no later than 10:00 a.m. on Monday, July 14, 2025. A hearing is set on Petitioners Motion for Temporary Restraining Order and Preliminary Injunction for Monday, July 14, 2025 at 4:00 p.m. in Courtroom 601, 401 West Washington Street, Phoenix, AZ 85003 before Judge Dominic W. MINUTE ENTRY for proceedings held before Judge Dominic W Lanza: Temporary Restraining Order and Preliminary Injunction Hearing held on 8/4/2025. Argument is presented as to Petitioner's Motion for Temporary Restraining Order and Motion for Preliminary Injunction (Doc. 22 ). For the reasons stated on the record, the motion is granted in part and denied in part, as follows: (1) the Court consolidates the request for preliminary injunction with a trial on the merits pursuant to Federal Rule of Civil Procedure 65(a)(2) as to the Counts One, Two, Three, and Four of the Amended Petition (Doc. 21 ), all of which involve challenges to Petitioner's detention; (2) Petitioner is ordered the prevailing party as to Counts One, Two, and Three of the Amended Petition; (4) Petitioner is therefore ordered released from custody, subject to the conditions of release that applied before the challenged revocation decision; (4) Petitioner's claim in Count Four is dismissed as moot in light of Petitioner's release from custody; and (5) Petitioner's request for a temporary restraining order and preliminary injunction related to her claim in Count Five, which challenges procedures related to third-country removal, is denied.
