On or before December 29, 2025, Respondents are ordered to show cause as to whether there are any factual or legal issues in this case that render it distinct from the Court's prior orders in the cases listed above and would justify denial of Preliminary Injunction. Respondents should also state whether they oppose this Court converting the Motion for Temporary Restraining Order to a Motion for Preliminary Injunction. Petitioner may follow a reply on or before December 30, 2025. The matter is not set for a hearing though the Court may set one should it later be determined that a hearing is necessary. MINUTE ORDER signed by Magistrate Judge Jeremy D. Peterson on 4/29/2026: After petitioner initiated this action, the court granted injunctive relief by way of ordering petitioner's release. (ECF No. 13 .) Still pending is petitioner's petition for writ of habeas corpus under 28 U.S.C. § 2241. (ECF No. 1 .) The primary dispute between the parties is whether re-detention without a pre-deprivation hearing violated petitioner's Fifth Amendment rights. Respondents have not filed any additional briefing since the court issued injunctive relief. Consequently, for the reasons stated in the court's prior order, ECF No. 13, the court finds that petitioner's due process rights were violated. Accordingly, IT IS HEREBY ORDERED that petitioner's petition for writ of habeas corpus, ECF No. 1, is GRANTED. If the government seeks to re-detain petitioner, it must provide no less than seven days' notice to petitioner and must hold a pre-deprivation bond hearing before a neutral arbiter pursuant to section 1226(a) and its implementing regulations, at which petitioner's eligibility for bond must be considered. This order does not address the circumstances in which respondents may detain petitioner in the event that petitioner becomes subject to an executable final order of removal.
