District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. The Court has reviewed the petition and the assented-to motion to stay. Doc. Nos. 1, 7. In light of both parties’ request for a court order directing Respondents to provide Petitioner a new bond hearing, Doc. No. 1 at 14; Doc. No. 7 at 1 n.2, the Court construes—and ORDERS Respondents to likewise construe—the pending petition as conveying a request for a bond hearing before an immigration judge. The Court further ORDERS that such a hearing shall be scheduled to occur by Tuesday, October 27, 2026; that the legal standard governing such hearing is as established by the First Circuit in Hernandez-Lara v. Lyons; that, in assessing whether the government has met its burden of proof as to flight or danger, the immigration judge shall consider whether any condition, combination of conditions, or less-restrictive alternative to detention would ameliorate such risk(s); and that the respondents shall not retaliate against Petitioner for the filing of this action. The parties shall file a joint status report by Monday, November 2, 2026, notifying the Court of whether a bond hearing has occurred and, if so, its outcome, and shall include a copy of any written order of the immigration judge. The assented-to motion to stay (Doc. No. 7 ) is ALLOWED insofar as Respondents’ obligation to answer the petition is STAYED pending further order of this Court.(FGD) (Entered: 10/20/2026)
