Memorandum Order: IT IS HEREBY ORDERED that Petitioners Motion at ECF No. 2 is DENIED insofar as it requests injunctive relief barring his transfer to another facility and insofar as Petitioner requests relief via a T.R.O. However, the Court will proceed to consider Petitioners Motion in so much as it requests relief via a P.I. based upon his remaining claim that 8 U.S.C. § 1226(a) governs his detention and that, as a result, he must either be released from custody or given a constitutionally adequate bond hearing. IT IS FURTHER ORDERED that Petitioner shall effectuate service of the filing at ECF No. 2 upon Respondents, alongside a copy of this Memorandum Order, within ten (10) days of the date of this Order. IT IS FURTHER ORDERED that Respondents shall file and serve a written Response to Petitioners Motion at ECF No. 2 within seven (7) days of receipt of service of that document. Petitioner may, but is not required to, file and serve a Reply to any Response submitted by Respondents within three (3) days of receipt of service of Respondents Response.
