Memorandum Order: IT IS HEREBY ORDERED that Petitioners Motion at ECF No. 2 is DENIED insofar as it requests injunctive relief barring his transfer to another facility and insofar as Petitioner requests relief via a T.R.O. However, the Court will proceed to consider Petitioners Motion in so much as it requests relief via a P.I. based upon his remaining claim that 8 U.S.C. § 1226(a) governs his detention and that, as a result, he must either be released from custody or given a constitutionally adequate bond hearing. IT IS FURTHER ORDERED that Petitioner shall effectuate service of the filing at ECF No. 2 upon Respondents, alongside a copy of this Memorandum Order, within ten (10) days of the date of this Order. IT IS FURTHER ORDERED that Respondents shall file and serve a written Response to Petitioners Motion at ECF No. 2 within seven (7) days of receipt of service of that document. Petitioner may, but is not required to, file and serve a Reply to any Response submitted by Respondents within three (3) days of receipt of service of Respondents Response. The Court will schedule a hearing as necessary. Signed by Judge Stephanie L. Haines on 12/23/25. (ljk) (Entered: 12/23/2025)

ORDER. Respondents have failed to meet the deadline for response ordered at 5, the Court hereby grants the 1 Petition for Writ of Habeas Corpus to the extent it seeks an individualized bond hearing before an immigration judge, and, in light of this relief, the 2 Motion for Temporary Restraining Order/Preliminary Injunction is moot. See Calzado Diaz v. Noem, No. 3:25- cv-458, 2025 WL 3628480 (W.D. Pa. Dec. 15, 2025) (Haines, J.), vacated as moot, ECF No. 22 (Dec. 17, 2025) (the legal conclusions in Calzado are unaffected by the mooting of the order due to the individual facts of Mr. Calzado Diaz's case); A.D. v. Leonard Oddo et. al., No. CV 25-460J, 2026 WL 101476, at *1 (W.D. Pa. Jan. 14, 2026). The Government is directed to provide Petitioner with the statutory process required under 8 U.S.C. 1226, which includes a bond hearing. The Government shall arrange for an individualized bond hearing to be conducted by an immigration judge by February 2, 2026. If Petitioner is not provided with a bond hearing by February 2, 2026, or if the immigration judge declines to conduct a bond hearing based on the findings in Hurtado, Respondents shall immediately release Petitioner from custody. The parties shall provide notice to the Court of the outcome of the individualized bond hearing within seven days of the date of the immigration judge's decision. With no further action required by the Court at this time, the Clerk of Court shall mark this matter closed. Signed by Judge Stephanie L. Haines on 1/22/2026.
