Judge Brian E. Murphy: ELECTRONIC ORDER DENYING 1 petition for writ of habeas corpus. Petitioner is not in custody, but brought this petition expressing fear that he would be detained at his then-upcoming Immigration and Customs Enforcement check-in on October 12, 2026, and requesting that the Court “[o]rder that Petitioner be immediately released following any detention,” and order that Petitioner not be re-detained or removed unless certain conditions are met. Dkt. 1 at 1, 14. The date of that check-in has since passed, and Respondents represent that Petitioner was not detained and “there is no intention to detain the Petitioner at the next check-in absent a change in circumstance.” Dkt. 8 at 1. “In order to bring a habeas petition, an individual must be in custody.” Rombot v. Moniz, 299 F. Supp. 3d 215, 218 (D. Mass. 2017) (citing 28 U.S.C. § 2241(c)). Accordingly, the petition is DENIED. (MBM) (Entered: 10/14/2026)
