Judge Brian E. Murphy: ELECTRONIC ORDER entered. “Respondents submit that the legal issues presented in this Petition concerning detention under 8 U.S.C. [s.] 1225(b)(1) are similar to those recently addressed by this Court in Rincon v. Hyde, No. 25-12633-BEM, 2025 WL 3122784 (D. Mass. Nov. 7, 2025) and Tenemasa-Lema v. Hyde, No. 25-13029-BEM, 2025 WL 3280555 (D. Mass. Nov. 25, 2025)” and that, “[s]hould the Court follow its reasoning in Rincon and Tenemasa-Lema, it would reach the same result here.” Dkt. 6 at 1-2. Accordingly, for the reasons stated in those cases, the Court will GRANT this Petition in part and order that Petitioner receive a constitutionally adequate bond hearing to consider the merits of his release.(MBM) (Entered: 01/05/2026)
