ORDER signed by Chief District Judge Troy L. Nunley on 7/14/2025 ORDERING that Petitioner's motion (ECF No. 9 ), construed as a motion for preliminary injunctive relief, is GRANTED. To return to the status quo -- the last uncontested status whi ch preceded the pending controversy -- Respondents must immediately release Petitioner under the same conditions he was released previously. In addition, the Court finds, prior to any redetention of Petitioner, Petitioner is entitled to notice of the reasons for revocation of his release and a hearing before an immigration judge to determine whether detention is warranted. At the hearing, the Government shall bear the burden of establishing, by clear and convincing evidence, that Petitioner poses a danger to the community or a risk of flight. The Court's July 4, 2025 Order (ECF No. 5 ) is VACATED. (Deputy Clerk MDK)

The parties are DIRECTED to file a joint status report within 14 days from the date of this order which includes a proposed briefing schedule on Petitioner's § 2241 application. The status report shall also address whether Petitioner is requesting discovery, the parties' positions on whether discovery is appropriate pursuant to Rule 6(b) of the Rul es Governing Section 2254 Cases and case law governing discovery in habeas corpus actions, as well as a proposed schedule for the completion of any proposed discovery. The Clerk shall amend the case caption and docket in this case to refer to Petitioner by his initials of "Y.S.G."
