MINUTE ORDER (Text Entry Only) The Court has reviewed the Petition filed under 28 U.S.C. § 2241 (Doc. 1) and the related request for emergency injunctive relief (Doc. 3). Petitioner (A File #: 245-031-238). The petitioner has not demonstrated that this matter, while exceedingly serious, should be treated as a procedural emergency. He has been held in custody since January 23, 2026 and was provided a bond hearing in May 2026, though the adequacy of that hearing is in dispute and under consideration in the Central District of California (Case No.: 5:26-cv-00314-JFW-DSR.) Even were he to be successful in his current action, the relied would not be release, but another bond hearing (Zadvydas v. Davis, 533 U.S. 678 (2001)). Thus, the motion for temporary restraining order (Doc. 3) is DENIED because plaintiff has failed to demonstrate a likelihood that he will prevail on the merits and because it is not timely (Local Rule 123(a)).On the other hand, this is the third such petition that the petitioner has filed and the second he has filed in this District. In the petition he filed in June in this Court (Case No.: 1:26-cv-04705 JLT EPG), the Court summarily dismissed the petition on July 29, 2026 because, though he raised the issue of over detention, he failed to demonstrate that the relief sought--release--was appropriate because his factual situation falls within the dictates of 8 U.S.C. § 1226(a). Thus, within 21 days, petitioner SHALL show cause why his petition should not be summarily dismissed in light of the fact that he received a bond hearing about five months ago.The Clerk of the Court is to notify the United States Attorney's Office for the Eastern District of California of this filing, by providing a Notice of Electronic Filing to usacae.ecf2241-imm@usdoj.gov.
