The Court has reviewed petitioner's 1 petition for writ of habeas corpus and 5 motion for temporary restraining order, and the government's 9 response. The parties are ordered to appear for a hearing on petitioner's 5 motion for temporary restraining order on July 10, 2025, at 9:30 a.m. in Courtroom 6 of the Robert E. Coyle Federal Courthouse. Respondents shall file any opposition by July 8, 2025, at 5:00 p.m. Petitioner may file a reply by July 9, 2025, at 4:00 p.m. In the meantime, and unless and until the Court orders otherwise, the Court ORDERS that respondents shall not remove petitioner from the United States nor transfer petitioner out of this District. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (noting court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). Written order to follow. For the reasons stated on the record, petitioner's 5 Motion for Temporary Restraining Order was converted to a Motion for Preliminary Injunction and is GRANTED. The government is ordered to immediately release petitioner from custody and, during the pendency of these proceedings, may not re-detain him without a pre-deprivation bond hearing before the San Francisco Immigration Court. Petitioner shall not be detained unless the government demonstrates, by clear and convincing evidence at any such bond hearing, that petitioner is a flight risk or danger to the community such that his physical custody is required.
