ORDER as to 1 granting petition for writ of habeas corpus for the reasons set out, (2) ordering that Petitioner be immediately released, and (3) upon immediate release, the conditions of the prior order of supervision which were in effect prior to his detention are reinstated. Petitioner must be immediately released from detention and returned to a reasonable proximity of the geographical location of his immigration proceedings. Further, Respondents are enjoined from relocating Petitioner outs ide the jurisdiction of the Court prior to compliance with this Order. Petitioner shall report to the Court any failure or deviation of Respondents from this Order. It is FURTHER ORDERED that Petitioner may file a motion for an award of attorneys' fees and costs under the Equal Access to Justice Act within thirty (30) days of this Order.
