PAPERLESS ORDER denying without prejudice Petitioner's pro se 12 Motion to Enforce (the "Motion"). Through counsel, Petitioner filed a Petition for Writ of Habeas Corpus on December 22, 2025. [ECF No. 1]. On March 13, 2026, the Court granted the Petition in part and ordered Respondents to provide Petitioner with an individualized bond hearing. [ECF No. 11]. Despite having counsel, Petitioner subsequently filed the instant pro se Motion, asserting that the Immigration Judge provided him an individualized bond hearing but denied Petitioner bond after finding him to be a flight risk. The pro se Motion must be denied because Petitioner still has counsel of record. See S.D. Fla. L.R. 11.1(d)(4) ("Whenever a party has appeared by attorney, the party cannot thereafter appear or act on the party's own behalf in the action or proceeding, or take any step therein, unless an order of substitution shall first have been made by the Court, after notice to the attorney of such party, and to the opposite party[.]"). See also United States v. Dale, 618 F. App'x 494, 497 (11th Cir. 2015) (finding that "the district court did not abuse its discretion in denying [a party's] pro se motion, filed while he was represented" by counsel).
