TRANSFER ORDER: Chen Yu ("Petitioner") filed a Petition 1 for Writ of Habeas Corpus ("Petition") pursuant to 28 U.S.C. § 2241. The Petition notes that Petitioner is currently detained at the Stewart Detention Center, located in Lumpkin, Georgia. (Pet. 3.) Under 28 U.S.C. § 2241(a), district courts are limited to granting habeas relief "within their respective jurisdictions." When interpreting this language, the Supreme Court has held that habeas petitions challenging present physical confinement may be brought in "one district: the district of confinement." Rumsfeld v. Padilla, 542 U.S. 426, 443 (2004). As such, this action is TRANSFERRED to the United States District Court for Middle District of Georgia. The Clerk of Court is respectfully directed to transfer this action in accordance with this Order and close this case. When doing so, it is further ordered that the seven-day waiting period in Local Civil Rule 83.1 shall be waived. Petitioner shall not be transferred outside the Middle District of Georgia without further order from the United States District Court for the Middle District of Georgia.
