Judge Richard G. Stearns: ELECTRONIC ORDER entered granting 7 Motion to Stay. The court agrees with the parties that Petitioner Marlon Alexis Portillo Garcia, who has been in the United States since 1999, without criminal history, is eligible for a bond hearing. As Portillo Garcia is held at Plymouth County House of Correction and the government must facilitate his transport to a bond hearing, the court directs ICE to arrange a bond hearing for him before an Immigration Judge (consistent with the standards outlined in Hernandez-Lara v. Lyons, 10 F.4th 19 (1st Cir. 2021)), as soon as practicable, but in no case later than Tuesday, October 13, 2026. The court STAYS this matter pending that hearing.
