ORDER TO SHOW CAUSE: The government is ordered to show cause on or before October 12 why Maita-Tenemaza should not be afforded a bond hearing at which respondents bear the burden of justifying his continued detention by clear and convincing evidence or, in the alternative, be released. See Black v. Decker, 103 F.4th 133, 150 (2d Cir. 2024), cert. granted sub nom. Genalo v. Black, 146 S. Ct. 2733 (June 15, 2026), cert. dismissed, No. 25-886, 2026 WL 2752021 (U.S. Sept. 11, 2026). The government's response should not exceed fifteen double-spaced pages. The Court finds that good cause exists to permit the government additional time to respond. 28 U.S.C. § 2243 ("The writ... shall be returned within three days unless for good cause additional time... is allowed."); see generally In re Habeas Corpus Cases, 216 F.R.D. 52, 53 (E.D.N.Y. 2003). Petitioner shall have until October 19 to file a reply, not to exceed ten double-spaced pages. ORDER ENCLOSED. The Clerk of Court is respectfully directed to mail a copy of this order to petitioner and to note the mailing on the docket. Ordered by Judge Eric R. Komitee on 9/28/2026.
