Judge Indira Talwani: ELECTRONIC ORDER: On December 20, 2025, Petitioner filed a Petition for Writ of Habeas Corpus [ 1 ] on the basis that he “face[d] an imminent risk of arrest and detention at or following his December 24, 2025 check-in” with U.S. Immigration and Customs Enforcement (ICE). Id. ¶ 35. On December 22, the court entered an Order Concerning Service of Petition and Stay of Transfer or Removal [ 4 ] asserting jurisdiction to determine the court’s jurisdiction to address the Petition [ 1 ] and staying Petitioner’s transfer to another district or outside of the United States without advance notice by the government.Respondents filed their Opposition [ 7 ] to the Petition [ 1 ] on December 23, in which they sought dismissal of the Petition [ 1 ] where Petitioner was “not subject to an immigration detainer, [was] not in DHS’s physical custody, and is not subject to a final order of removal.” Opp’n at 4 [ 7 ].In light of Respondents’ Opposition [ 7 ], no later than January 9, 2026, Petitioner shall show cause why this court should not dismiss his Petition [ 1 ].
