TEXT ORDER - This matter comes before the Court upon Petitioner's Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241. (ECF No. 1) The Court notes that Petitioner previously filed a Petition for a Writ of Habeas Corpus in this District, captioned Perez Cortes v. Warden, Delaney Hall Detention Facility, Civ. No. 1:26-cv-12721-KMW, challenging his detention at Delaney Hall Detention Facility. In that matter, the Court granted the Petition in part and directed Respondents to provide Petitioner with an individualized bond hearing. The Court subsequently considered Petitioner's Motion to Enforce Judgment, reviewed the record of the August 14, 2026 bond hearing, and determined that the hearing satisfied the requirements of due process and fundamental fairness. The Court denied the Motion to Enforce Judgment and directed the Clerk to close the matter on September 23, 2026. The Court further notes that the Petition presently before the Court appears to raise claims concerning Petitioner's detention that were raised, or could have been raised, in the prior action. The present Petition does not identify the prior action or otherwise explain whether the claims asserted herein are based upon any factual or legal development occurring after the September 23, 2026 Order. Accordingly, it is ORDERED that within seven (7) days, Petitioner shall SHOW CAUSE in writing why the Petition should not be dismissed as duplicative. Petitioner's response shall specifically identify any claim asserted in the present Petition that was not raised, and could not have been raised, in Civ. No. 1:26-cv-12721-KMW, and shall identify any material factual or legal development occurring after September 23, 2026, upon which such claim is based. Respondents need not file a response to the Petition unless and until otherwise directed by the Court. Petitioner shall not be transferred from the District of New Jersey during the pendency of these proceedings. So Ordered by Judge Karen M. Williams on September 29, 2026. (Williams, Karen) (Entered: 09/29/2026)
