TEXT ORDER granting 1 Petition for Writ of Habeas Corpus: The Court GRANTS Petitioner Robenson Jean's petition. Without addressing the merits of the ancillary issues raised by Mr. Jean, including a viable Fourth Amendment claim (See generally, on September 16, 2026, masked ICE agents arrested Petitioner without a warrant while he was seated in a friend's parked car in the parking lot of the Worcester Police Department, where they had gone to report Petitioner's stolen wallet. Petitioner was not engaged in any unlawful or suspicious activity, and his wife, two-year-old daughter, and friend were also present in the vehicle. The masked agents did not identify themselves, explain the basis for the arrest, or ask Petitioner any questions concerning his immigration status or whether he posed a flight risk before handcuffing and detaining him), Respondents are ORDERED to immediately release Robenson Jean as he awaits his bond hearing scheduled on October 5, 2026 at 3:30 PM at the Chelmsford, Massachusetts Immigration Court. Respondents are ORDERED to file a status report within 14 calendar days of this Order stating whether Mr. Jean has been granted bond, and, if his request for bond was denied, the reasons for that denial. The Court continues to carefully review the torrent of habeas petitions through the lens of the First Circuit opinion in determining whether petitioners are entitled to a discretionary bond hearing under 8 U.S.C. §1226(a). In doing so, the Court expects Respondent's in the future to provide the actual record of the Government's statutory basis for a petitioner's arrest and detention. So Ordered by Chief Judge John J.
