TEXT ORDER: This matter comes before the Court on Petitioner Jonathan Fernando Tapia Olmedo's petition for a writ of habeas corpus (ECF No. 1, "Petition") pursuant to 28 U.S.C. § 2241 seeking immediate release from custody. Petitioner had a bond hearing before the immigration court on September 29, 2026, and an immigration judge denied bond based on flight risk. (ECF Nos. 5; 6.) Petitioner filed a reply (ECF No. 7) in which he requested immediate release from custody but did not cite any authority that would allow this Court to release him. Petitioner's reply also contested the fundamental fairness of the bond hearing, arguing that it violated his due process rights. (Id. at 1-2.) Petitioner, however, also stated that, if this Court is unable to immediately release him from custody, he requests to withdraw his Petition so that he may seek voluntary departure. (Id.) This Court is unable to release Petitioner based solely on the current record. Therefore, if Petitioner wishes to withdraw his Petition, he may do so by filing a notice of voluntary dismissal pursuant to F.R.C.P. 41(a)(1)(A). If Petitioner instead wishes to challenge the fundamental fairness of his bond hearing, then Petitioner shall file supplemental briefing on that issue with all arguments and citations to the relevant authorities in support of his position within seven (7) days of this Order. So Ordered by Judge Katharine S. Hayden on 10/6/26. (cm, ) (Entered: 10/06/2026)
