Text of Order: The court has reviewed the petition for writ of habeas corpus (doc. no. 1), in which the petitioner challenges her detention by the Department of Homeland Security and seeks relief under the Due Process Clause and under 8 U.S.C. § 1226(a). The petitioner asserts that she is entitled to class relief under Guerrero Orellana v. Moniz, 813 F. Supp. 3d 185 (D. Mass. 2025), aff'd, 2026 WL 2352042 (1st Cir. Aug. 13, 2026), but does not allege that she has requested a bond hearing before an Immigration Judge. See id. at 196 (class members are entitled to a custody redetermination hearing "upon request" to an Immigration Judge (emphasis added)). To allow the court to consider the merits of the petition, on or before October 2, 2026, the petitioner shall supplement the petition with factual, non-conclusory allegations substantiating her claim, including allegations that clarify whether, when, and to whom a request for custody redetermination was made, and the specifics of any response to that request.
