TEXT ORDER re Petitioner's 2 Motion for Temporary Restraining Order. There is no need to interfere with the Department of Homeland Security's authority to "arrange for appropriate places of detention for aliens detained pending removal or a decision on removal[,]" under Title 8, United States Code, Section 1231(g)(1), because this Court will retain jurisdiction over Petitioner's habeas petition regardless of where he is transferred. See Santillanes v. U.S. Parole Comm'n, 754 F.2d 887, 888 (10th Cir. 1985) ("It is well established that jurisdiction attaches on the initial filing for habeas corpus relief, and it is not destroyed by a transfer of the petitioner and the accompanying custodial change."). Accordingly, the portion of Petitioner's motion for a temporary restraining order that asks this Court to enjoin his transfer to a different facility is DENIED. The balance of his temporary restraining order application will be addressed in due course. The Court will address next steps in the case on Monday, December 22, 2025. SO ORDERED. by Hon. John L. TEXT ORDER. Through counsel, Petitioner seeks relief under 28 U.S.C. § 2241. Dkt. 1. Petitioner also seeks a temporary restraining order ("TRO"). Dkt. 2. On December 19, 2025, the Court denied the portion of Petitioner's TRO motion that asked for an order enjoining his transfer to a different facility. Dkt. 4. The balance of his TRO motion is pending. Counsel shall confer regarding a briefing schedule on the petition and the balance of the TRO motion, and shall file a letter outlining their proposed briefing schedule by December 24, 2025. The Clerk of Court shall serve a copy of the petition (Dkt. 1), the TRO (Dkt. 2), and a copy of this text order, electronically via a Notice of Electronic Filing to the United States Attorney's Office, Western District of New York at USANYW-Immigration-Habeas@usdoj.gov.
