DOCKET TEXT ORDER. "[F]or core habeas petitions challenging present physical confinement, jurisdiction lies in only one district: the district of confinement." Rumsfeld v. Padilla, 542 U.S. 426, 443 (2004). Jurisdiction over a habeas petition "attaches on the initial filing for habeas corpus relief." Santillanes v. United States Parole Comm'n, 754 F.2d 887, 888 (10th Cir. 1985). 1 Petition for Writ of Habeas Corpus Under 28 U.S.C. § 2241, however, contains no non-speculative allegations that would support a conclusion that Petitioner was in fact confined in the District of Utah at the time the petition was filed. To the contrary, Petitioner alleges that he was confined in Wyoming the day before the petition was filed and merely surmises that he might pass through Utah en route to another destination at some time the following day. See Dkt. No. 1 at 4. And the court has been unable to locate Petitioner through the U.S. Immigration and Customs Enforcement's Online Detainee Locator System either yesterday or today. No later than October 1, 2026, Petitioner shall unequivocally confirm that he was in fact confined in the District of Utah at approximately 4:00 PM on September 25, 2026, when the petition was filed, or otherwise show cause why the petition should not be dismissed for lack of jurisdiction.
