District Judge Angel Kelley: ELECTRONIC ORDER entered. On September 24, 2026, Petitioner was detained at the ICE Boston Field Office in Burlington, Massachusetts. [Dkt. 1]. That same day, at 4:04 PM, Petitioner filed a Petition for a Writ of Habeas Corpus. [Dkt. 1]. At 8:28 PM that same day, Respondent's filed a Notice informing the Court that Petitioner was transferred to Wyatt Detention Facility in Central Falls Rhode Island. [Dkt. 6]. Respondents represented that Petitioner departed the Boston Field Office in Burlington, Massachusetts at 3:51 PM, approximately thirteen minutes before the Petition was filed. [Id.]. Given the location of Burlington from the Massachusetts border, Petitioner was likely still in Massachusetts at the time the Petition was filed, and, therefore, the Court likely has jurisdiction over the Petition. The next morning the Court acknowledged that Petitioner had been transferred to Rhode Island and order that "[s]hould Respondents seek to transfer Petitioner out of the District of Rhode Island, they shall provide advance notice of at least 72 hours." [Dkt. 7]. That afternoon, Petitioner filed an Emergency Motion for Return to the District of Massachusetts [Dkt. 9] to which Respondents filed a Response [Dkt. 10]. In their Response, Respondents indicated that Petitioner was transferred to Wyatt Detention Facility in Rhode Island because there is limited bedspace in Plymouth County Correctional Facility. Plymouth and Wyatt are the closest detention facilities for individuals detained in Boston. Respondents further indicated that they are working to "confirm[] with the agency the timeframe that [Petitioner] crossed the Massachusetts-Rhode Island state line." [Dkt. 10]. Given the likely jurisdiction in Massachusetts and Respondents ongoing efforts to determine Petitioner's location at the time the Petition was filed, the Court ORDERS that Petitioner shall not be transferred from either Massachusetts or Rhode Island until further order of the Court.(MAL) (Entered: 09/25/2026)
