Minute Order by Judge Jinsook Ohta: After examining Petitioner's request for appointment of counsel (see Dkt. 1 at 2), the Court finds that representation is necessary given the complexity and potential merit of the constitutional, statutory, and procedural issues presented. See 18 U.S.C. § 3006A(a)(2)(B); Weygandt v. Look, 718 F.2d 952, 954 (9th Cir. 1983). Accordingly, the Court CONDITIONALLY APPOINTS Federal Defenders of San Diego, Inc. as counsel for Petitioner, subject to Federal Defenders' review of the case and acceptance of the appointment. Federal Defenders shall review the case and determine whether to accept the appointment, considering Petitioners financial eligibility for appointed counsel, Federal Defenders' available resources, and any other relevant circumstances. On or before September 29, 2026, Federal Defenders shall notify Petitioner and file a notice with the Court indicating whether it accepts or declines representation. If Federal Defenders accepts the appointment, the Court ORDERS Petitioner to file (1) an amended petition by October 6, 2026, and (2) a Form CJA 23 financial affidavit by October 20, 2026, demonstrating financial eligibility for appointed counsel. See Terronova v. Kincheloe, 912 F.2d 1176, 1182 (9th Cir. 1990). If Federal Defenders declines representation, Petitioner shall continue to proceed without counsel.
