TEXT ORDER: Consistent with the First Circuit opinion and the thread of cases in this district addressing detentions under § 1226(a), the Court GRANTS the petition. Guerrero Orellana v. Moniz, Nos. 25-2152, 26-1094, 2026 WL 2352042, (1st Cir. Aug. 13, 2026). As such, Respondents are ORDERED to immediately release Cristian Daniel Menjivar-Alfaro as he awaits his bond hearing scheduled on October 5, 2026 at 3:30 PM at the Chelmsford, Massachusetts Immigration Court. Respondents are ORDERED to file a status report within 14 calendar days of this Order stating whether Mr. Menjivar-Alfaro has been granted bond, and, if his request for bond was denied, the reasons for that denial.
