MINUTE ORDER issued by Courtroom Deputy for Chief District Judge Troy L. Nunley on April 15, 2026: This matter is before the Court on Petitioner's Motion for Temporary Restraining Order. (ECF No. 2 .) Respondents filed an opposition. (ECF No. 5 .) Petitioner filed a reply. (ECF No. 6 .) The Court has reviewed the parties' papers and finds Petitioner has not carried his burden to show a likelihood of success on his claims that Respondents violated the Fifth Amendment Due Process Clause. See Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7, 20 (2008) (standard for temporary restraining order). Petitioner is subject to a final order of removal, thus, he is subject to detention under 8 U.S.C. § 1231. (ECF No. 5 at 3.) It appears Petitioner's removal is significantly likely and this Court's Order not to transfer Petitioner out of this district is the only impediment to Petitioner's removal as Petitioner has not filed an emergency stay of the removal order with the Board of Immigration Appeals. Accordingly, Petitioner's Motion for TRO is DENIED. The Court will rule on the Petition for Writ of Habeas Corpus ("the Petition"). Respondents may file a response by May 15, 2026. Petitioner may file a reply by June 12, 2026. If the parties do not timely file, this Court will assume they rest on the record.
