TEXT ORDER: Before this Court is Petitioner Philippe Didier Angrand's Petition for Writ of Habeas Corpus. ECF No. 1. To address Respondent's argument concerning parolees as "seeking admission" the Court directs the Respondent's to the First Circuit opinion. See Guerrero Orellana v. Moniz, No. 25-2152, 2026 WL 2352042, at 21 (1st Cir. Aug. 13, 2026) (explaining that certain parolees are not "seeking admission" because parole is distinct from admission, and that noncitizens present in the United States without admission are governed by § 1226 rather than § 1225(b)(2)(A)). The Court GRANTS the Petition. As such, Respondent are ORDERED to immediately release Phillipe Didier Angrand and provide him with a bond redetermination hearing under 8 U.S.C. § 1226(a) within 10 calendar days of this Order. Respondents are ORDERED to file a status report within 14 calendar days of this Order stating whether Mr. Angrand has been granted bond, and, if his request for bond was denied, the reasons for that denial. The ancillary issues raised by the Respondents are rejected by the Court for the reasons stated in numerous orders previously before the Court concerning § 2241 immigration habeas petitions.
