ORDER TO ANSWER, 28 U.S.C. § 2241: The Clerk of Court shall electronically notify the Civil Division of the U.S. Attorney's Office for the Southern District of New York of this Order. By September 23, 2026, at 5:00 p.m., Respondents sha ll file a letter with the Court with the information described in this order. Respondents shall file an answer to the Petition within three business days of the date of this Order. Petitioner shall file any reply within ten business days of the date of this Order. ORDER DIRECTING PAYMENT OF FEE OR IFP APPLICATION: Accordingly, within 30 days of the date of this order, Petitioner or her next friend must pay the $5.00 filing fee or submit a completed and signed IFP application. If an IFP application is f iled, it should be labeled with docket number 26-CV-8229 (LJL). If the Court grants the IFP application, this action will proceed without the prepayment of fees. See 28 U.S.C. § 1915(a)(1). If Petitioner and her next friend fail to comply with t his order within the time allowed, and do not request additional time to respond, the Court will dismiss this action without prejudice to refiling. Because, at this time, the petition makes no substantial showing of a denial of a constitutional righ t, a certificate of appealability will not issue. See 28 U.S.C. § 2253. The Court certifies, under 28 U.S.C. § 1915(a)(3), that any appeal from this order would not be taken in good faith and, therefore, IFP status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that appellant demonstrates good faith when seeking review of a nonfrivolous issue). ORDER: The Court directs the Clerk of Court to transfer this action to the District of New Jersey. To ensure that Petitioner has an opportunity to have this petition considered by the District of New Jersey, and to preserve the status quo, the Cou rt enjoins the government from removing Petitioner from a facility within this District, the District of New Jersey, or the Eastern District of New York. See Khalil v. Joyce, 771 F. Supp. 3d 268, 291 (S.D.N.Y. 2025) ([T]o ensure that [Petitioner] gets an opportunity to have his Petition and these motions considered by a court in the normal course and to preserve the status quo - the Court's... Order barring the Government from removing him (to which the Government has never raised a n objection and which the Government has not asked the Court to lift in the event of transfer) shall similarly remain in effect unless and until the transferee court orders otherwise.). The Court waives Local Civil Rule 83.1, which requires a seven -day delay before the Clerk of Court may transfer a case, and directs immediate transfer. The United States Attorney is directed forthwith to alert the Chief of the Civil Division United States Attorney's Office for the District of New Jersey of the transfer of this matter. The Court directs the Clerk of Court to mail a copy of this order to Petitioner and email Ninibeth Rivas Jiminez at the addresses on record. The United States Attorney is further directed to request that ICE print a c opy of this Order and deliver it to the Petitioner. In the letter to be filed by September 25, 2026 at 12:00 p.m., the Government shall attest to its attempts to hand-deliver this order to the Petitioner.
