TEXT ORDER: The Court has reviewed the Petition for Writ of Habeas Corpus, ECF No. 1, Respondents' submissions, ECF Nos. 4, 5, and 7, and the Declaration of Derek Lynch, ECF No. 5-1. The record reflects that Petitioner departed New Jersey at approximately 1:23 a.m. on August 31, 2026, and that counsel thereafter electronically filed the Petition in this District at approximately 12:58 p.m. that same day. Accordingly, Petitioner was not confined within this District when the Petition was filed. See 28 U.S.C. § 2241(a). At the time the Petition was filed, Petitioner was detained at the Richwood Correctional Center in Monroe, Louisiana. The Court therefore concludes that the Petition could have been brought in the United States District Court for the Western District of Louisiana. Pursuant to 28 U.S.C. § 1631, and because transfer is in the interest of justice, this action is hereby TRANSFERRED to the United States District Court for the Western District of Louisiana. The Court's August 31, 2026 Order, ECF No. 2, is hereby VACATED. The Clerk of Court shall effectuate the transfer forthwith. So Ordered by Judge Jamel K. Semper on 9/22/2026.
