ORDER: The Court is in receipt of a 1 petition for a writ of habeas corpus docketed today which was filed by Rocio Santiago as Next Friend of petitioner Eulogio Nava Bobadilla. Bobadilla is identified as Santiago's uncle. Next friend standing requires (1) “an adequate explanation—such as inaccessibility, mental incompetence, or other disability—why the real party in interest cannot appear on his own behalf,” and (2) that the next friend "be truly dedicated to the best interests of the” petitioner and “have some significant relationship” with the petitioner. Whitmore v. Arkansas, 495 U.S. 149, 163–64 (1990). By 9/28/2026, Santiago is directed to explain why a challenge to Bobadilla’s detention is appropriately pursued as litigation by his “next friend,” instead of through a petition filed by Bobadilla. The Clerk of Court is respectfully directed to mail a copy of the order to Santiago and to send a copy of this order to Santiago at the e-mail address listed on the petition.
