TEXT ORDER - The Court has reviewed the Petition for Writ of Habeas Corpus (ECF No. 1) Motion for Temporary Restraining Order (ECF No. 2), Motion for Immediate Release Without Monetary Bond (ECF No. 3) and Motion for Expedited Consideration and Request for Temporary Relief (ECF No. 4) filed by pro se Petitioner Elmer Edenilson Rodriguez Jovel ("Petitioner"). Petitioner alleges that he entered the United States on or about August, 2023, that he has no final order of removal (ECF No. 3 at 2), and no criminal record (ECF No. 1 at 1, ECF No. 2 at 4). Petitioner further alleges that he was detained by ICE without explanation, and transferred to the Delaney Hall Detention Facility in Newark, New Jersey, where he remains without a scheduled bond hearing. (ECF No. 2.) Petitioner contends that his continued detention violates the Due Process Clause of the Fifth Amendment and seeks immediate release or a bond hearing before an Immigration Judge. (ECF No. 1 at 2-3.) Accordingly, Respondents shall SHOW CAUSE, within seven (7) days of the filing of this Order, why the relief sought should not be granted. Petitioner may file a reply within three (3) days after Respondents file their response. Petitioner shall not be transferred from New Jersey during the pendency of these proceedings. Petitioner's Motion for Temporary Restraining Order (ECF No. 2) is DENIED as MOOT. The Court will address Petitioner's pending motions (ECF Nos. 3, 4) following receipt of the Government's Response.
