TEXT ORDER - The Court has reviewed the Petition for Writ of Habeas Corpus (ECF No. 1) filed by Petitioner Juan Camilo Giraldo Rivera ("Petitioner"). According to the Petition, Petitioner is a native and citizen of Colombia who was inspected and admitted to the United States on January 8, 2025 pursuant to a valid B-2 nonimmigrant visitor visa. Petitioner alleges that his authorized period of stay extended through July 7, 2025, and that on January 20, 2025, he timely filed an affirmative application for asylum, which remains pending. Petitioner further alleges that on September 18, 2026, while traveling through Newark Liberty International Airport in Newark, New Jersey, immigration officers arrested him and transported him to Delaney Hall Detention Facility in Newark, New Jersey, where he remains detained. Petitioner contends that his continued detention violates the Due Process Clause of the Fifth Amendment, and seeks his immediate release. (Id.) Accordingly, Respondents shall SHOW CAUSE, within seven (7) days of the filing of this Order, why the relief sought should not be granted. Petitioner may file a reply within three (3) days after Respondents file their response. Petitioner shall not be transferred from New Jersey during the pendency of these proceedings.
