Judge Mark G. Mastroianni: ELECTRONIC ORDER entered GRANTING IN PART 1 Petition for Writ of Habeas Corpus. Petitioner Yenner Ottoniel Sandoval Lopez is presently detained at the Plymouth County Correctional Facility. (Pet., Dkt. No. 1 24.) In his petition, he alleges that he is a law-abiding individual with no history of arrests or criminal convictions. (Id. 21.) Respondents do not dispute these allegations. More importantly, Respondents agree that Petitioner is eligible for a bond hearing and do not object to the court ordering such a hearing without further briefing or oral argument. (Dkt. No. 10 at 1.) Based on the parties filings, the court concludes that Petitioner is a member of the class certified in Guerrero Orellana v. Moniz, 808 F. Supp. 3d 167, 190 (D. Mass. 2025) and is therefore entitled to a bond hearing. See Guerrero Orellana v. Moniz, 813 F. Supp. 3d 185, 196 (D. Mass. 2025), aff'd, No. 25-2152, 2026 WL 2352042 (1st Cir. Aug. 13, 2026). Accordingly, it is hereby ORDERED that: 1) Within seven (7) days of this order, Respondents shall provide Petitioner with a bond hearing pursuant to 8 U.S.C. § 1226(a). At that hearing, Respondents shall bear the burden of establishing that Petitioner poses a danger or flight risk sufficient to justify continued detention. See Hernandez-Lara v. Lyons, 10 F.4th 19, 39 (1st Cir. 2021). If Respondents fails to provide Petitioner with a bond hearing within that period, Petitioner shall be released; 2) Respondents shall provide Petitioner and class counsel with no fewer than seventy-two (72) hours' notice before initiating any transfer of Petitioner outside the First Circuit; 3) If they have not already done so, Respondents shall serve Petitioner with the Third Notice issued in Guerrero Orellana v. Moniz, No. 25-cv-12664-PBS (Dkt. No. 212) (D. Mass. Sep. 18, 2025). If Petitioner is not fluent in English, Respondents shall provide the Third Notice in both English and his language of fluency; 4) As soon as practicable, but no later than three (3) hours after Petitioner receives the Third Notice, Respondents shall provide Petitioner access to a telephone to contact an attorney of his choice, including class counsel at (857) 347-5502; and 5) Within three (3) days after the bond hearing, Respondents shall file a status report advising the court of the outcome of the hearing.
